When Should I Contact a Personal Injury Attorney?

The obvious answer to the question "When should I get an attorney to help with my personal injury claim?" is "as soon as possible." The reason for this is that there are time limits on how long you have to file a lawsuit.

Each state has laws called "statutes of limitation" that govern these time limits. Stated another way, the laws place limits on the amount of time you are allowed to file a personal injury lawsuit.

It varies from state to state, and in Tennessee this time limit is one year for personal injury. This means that the clock begins to countdown from the date when your claim "accrues." For example, if you were injured in a car accident on April 1st, that is the starting date for your time limit. You will have one year (in Tennessee) from that date to file your lawsuit. Other types of personal injury claims may have a different statute of limitation. Medical Malpractice, for example, is one type of case where the time period may be different.

This does not mean, however, that the lawsuit has to be finished during this year. The actual time it takes to conclude your personal injury lawsuit could take much longer. The statutes of limitations do not apply to this. They only apply to when you can file your suit.

If you wait too long to contact us, you risk missing the legal time limit for filing your personal injury lawsuit. Once "the bell has rung" and the statute of limitations has expired, you cannot file a lawsuit.
