DUI crash results in fatality, wrongful death suit may follow

Tennessee car accidents can have long-lasting effects. When an individual is seriously injured or killed, these effects can follow that person or the loved ones of a deceased victim for the rest of their lives. When a car accident takes the life of an innocent victim, that individual's surviving family may choose to file a wrongful death lawsuit against the driver believed to have been responsible.

One such accident occurred earlier this year. It happened in Memphis on Highway 385 around 3:30 p.m. The four-vehicle crash resulted in the death of one motorist. Three other people suffered injuries, one of them critically.

According to investigators, the accident occurred when an SUV driven by a 17-year-old was traveling eastbound on the highway. It left the roadway, crossed the median and ultimately collided with a car coming from the other direction. The driver of that vehicle was killed, while a passenger suffered critical injuries. The SUV then struck a second vehicle, whose three occupants all suffered injuries; another car was also struck, though no one in that vehicle was hurt. The investigation as well as the toxicology results were recently completed, and the unidentified 17-year-old was formally charged with vehicular homicide, DUI, texting while driving and a number of related charges.

Although a wrongful death claim can do little to erase a family's grief, a successfully presented claim could provide some relief from the financial burdens that are typically associated with a tragic death such as this one. Any compensation derived from a properly litigated claim may be used to cover end of life expenses and related financial losses. A Tennessee family who is grieving the loss of a loved one typically consults with an experienced personal injury attorney, who can advocate for their needs as well as assist them with the process of submitting a claim. Similarly, seriously injured accident victims have a right to pursue claims for personal injury.
