Alleged nursing home neglect results in wrongful death claim

The elderly in Tennessee are often left at the mercy of those who are supposed to care for them. A recent case in which the administrator of the estate of an elderly lady has sued the nursing home who cared for the now deceased woman, alleging neglect. In the wrongful death claim, it is claimed that the needed medical care was not provided when needed.

The complaint asserts that the woman suffered fractures to the humerus bone in her upper arm after a fall. The plaintiff alleges that the nursing home should be held responsible for insufficient care provided as the staff did not provide supervision appropriate to the circumstances. Furthermore, it is claimed that sufficient medical treatment and subsequent care to treat the broken bone were not ensured.

The plaintiff seeks to hold the nursing home responsible as the painful injuries resulting from the fall allegedly led to a general decline in health. It is claimed that the neglect caused, or at least contributed, to the women's death. Should the court find that the staff at the nursing home neglected their duties toward the woman, the court may award financial damages to the estate of the deceased.  

Unfortunately, cases such as this one happen more than many care to acknowledge. Tennessee families who suspect possible nursing home neglect of a family member may benefit from consulting with an attorney regarding the possibility of filing a personal injury or wrongful death claim, depending on the specific circumstances. Should there be sufficient proof that negligence caused or contributed to an accident, a civil court may direct the entry of a monetary judgment for documented financial losses.
